Introduction 

Federal law requires that SalientMG, LLC, and its affiliates, employees, members, agents, and partners (collectively “we”) tell you how we collect, use, share, and protect your personal information. Federal law also limits how we can use your personal information. Protecting the privacy and security of all consumers’ personal information is very important to us. 

This policy sets forth how we treat personal information that we collect and receive, if any, regarding your use of our products and services, including information collected through our website or applications (including any mobile applications). Personal information includes information about you that is personally identifiable, such as your name, address, email address, or phone number, and that is not otherwise publicly available. We may combine personal information collected from you with information from other services or third parties to provide a better user experience.

By using our site or any of our applications (collectively “Site”) and using our services, you consent to the collection and use of this information in the manner we describe herein. If there are any terms in this privacy policy that you do not agree with, please immediately discontinue use of our Site and our services.

Information Collection and Use 

The personal information that we collect depends on the context of your interactions with us and the Site, the choices you make and the products and features you use. You do not have to give us personally identifiable information in order to visit our Site. However, in order to request our services, sign up for a user account, participate in a survey or otherwise express an opinion, you may be required to register with our Site.  The personal information we collect can include the following:

We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

Vendors, Consultants and Other Third-Party Service Providers. Examples include:  data analysis, email delivery, hosting services, customer service and marketing efforts.  This information may be used to, among other things, analyze and track data, determine the popularity of certain content and better understand online activity. Unless described in this Policy, we do not share, sell, rent or trade any of your information with third parties for their promotional purposes.

Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

Third-Party Advertisers. We may use third-party advertising companies to serve ads when you visit the Site. These companies may use information about your visits to our Site and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you. Affiliates. We may share your information with our affiliates, in which case we will require those affiliates to honor this privacy policy. Affiliates include any subsidiaries, joint venture partners or other companies that we control or that are under common control with us.

With your Consent. We may disclose your personal information for any other purpose with your consent.

We may work with third-party advertising companies which may use information about your visit to the Site in order to provide advertisements about goods and services that may be of interest to you on the Site and on third-party Web sites. 

We do not rent, sell, or share any information about you with people under any circumstances except as set forth herein.  

Cookies

We may set and access cookies on your computer.  A cookie is a small text file that our web server places on a user’s computer hard drive to be a unique identifier.  Cookies enable you to use our Site and services and enable us to track usage patterns and deliver customized content to users. Our cookies do not collect personally identifiable information, passwords or credit card numbers.  You may modify your browser preference to provide you with choices relating to cookies. If you choose to reject all cookies, you may not be able to access our Site.

Links

This Site may provide you with links in a format that allows us to track whether these links are used by our visitors.  We use this information to improve our technology, customize content on our Site and customize advertising on our Site.  Please be aware that the advertisers or web sites that have links on our Site may collect personally identifiable information about you.  The information practices of those web sites linked to the site either through advertisements or other hyperlinks are not covered by this privacy statement.

Community Discussion Boards

Our Site offers the ability for users to communicate through online community discussion boards. We do not filter or monitor what is posted on such discussions boards and if you choose to post or provide information on these boards, such information is not protected by our privacy policies, nor will we be liable if you disclose personal information through such postings. We cannot prevent the use or misuse of any information you post by others.

Policy Regarding Minors

We recognize the need to provide additional privacy protections when children visit this Site.  The Children’s Online Privacy Protection Act (“COPPA”) requires that we inform parents and legal guardians about how we collect, use, and disclose personal information of children under 13 years of age and that we obtain the consent of parents and guardians in order for children under 13 years of age to use certain features of our Site. We do not knowingly solicit or collect personal information from children. 

While we have no way of distinguishing the age of individuals who access our Site, we never knowingly ask a child under 18 to divulge personal information without first obtaining parental or guardian consent.  If we learn that personal information from users less than 18 years of age has been collected, we will deactivate the account and take reasonable measures to promptly delete such data from our records.  If you think that your child has provided us with personally identifying information the parent or guardian should contact us at [email protected] to remove the information.  Please include “Child Privacy” in the subject line of your email.  

Privacy Rights

In some regions, like the European Economic Area, you have certain rights under applicable data protection laws.  These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; and (iv) if applicable, to data portability. In certain circumstances, you may also have the right to object to the processing of your personal information. If we are relying on your consent to process your personal information, you have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal.

If you are resident in the European Economic Area and you believe we are unlawfully processing your personal information, you also have the right to complain to your local data protection supervisory authority. You may at any time review or change the information in your account or terminate your account by logging into your account settings and updating your account settings. 

Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms of Use and/or comply with legal requirements.

Cookies and similar technologies: Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Sites. 

Opting out of email marketing: You can unsubscribe from our marketing email list at any time by clicking on the unsubscribe link in the emails that we send or by contacting us at [email protected].  Please include “Unsubscribe” in the subject line of your request.  You will then be removed from the marketing email list – however, we will still need to send you service-related emails that are necessary for the administration and use of your account. 

California Residents  

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. International Information Transfer

We may transfer, store, and process your information in countries other than your own.

Our servers are located in the United States. If you are accessing our Sites from outside the United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see “Disclosure of Your Information” above), in other countries.

If you are a resident in the European Economic Area, then these countries may not have data protection or other laws as comprehensive as those in your country. We will however take all necessary measures to protect your personal information in accordance with this privacy policy and applicable law.

How Long Information is Retained

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

We are strongly committed to protecting any personal information collected through this Site against unauthorized access, use, or disclosure.  We have implemented procedures to safeguard the integrity of its information, including, but not limited to, monitoring, auditing, and reviewing our security measures.  These security procedures have been integrated into the design, implementation, and day-to-day operations of this Site as part of our continuing commitment to the security of electronic content.

Changes and Notification

We reserve the right to modify our Privacy Policy at any time. If our Privacy Policy changes, we will post the revised policy on this Site. Please note that the use of information that we gather is subject to the privacy notice in effect at the time of use.  You should check our web Site frequently to see recent changes. 

Disputes

This privacy policy shall be governed by and construed in accordance with the laws of the State of Maryland notwithstanding any conflict of laws provisions.  You irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the federal courts of Maryland and the state courts located in Howard County, Maryland for any litigation or dispute arising out of or relating to this privacy policy.  If you have any concerns about your privacy in connection with this policy, please send us a thorough description of your concerns to [email protected]  and we will try to resolve it.  Please include “Privacy Concern” in the subject of your email.
